Family Based Immigration Petitions

United States citizens are able to petition for family members, including spouses, parents, children and siblings, to become permanent residents and start on the path to citizenship. There are numerous visa types for family members of United States citizens. Our firm advises clients regarding the category that fits their specific circumstances, including the following:

  • Immediate Relatives: Children (under 21), parents, and spouses of United States Citizens.
  • FB-1 First Preference: Unmarried sons and daughters of United States citizens.
  • FB-2 Third Preference: Married sons and daughters of United States citizens.
  • FB-4 Fourth Preference: Brothers and sisters of United States citizens.

  • Intra-Company Transfer Visa (L visa): L-1 visas are available to executives, managers and specialized knowledge employees transferring to their employer’s United States affiliate, parent or subsidiary. Executives and managers holding L-1 visas may be eligible for permanent residency without the need for a labor certification.
  • Investor Visa (E visa): Investors and traders and their employees may receive visas to carry on their businesses in the United States if their home country has a commercial treaty with the United States conferring visa eligibility.
  • Professional Visa (H1-B visa): Professional workers with at least a bachelor’s degree (or its equivalent work experience) may be eligible for a non-immigrant visa if their employers can demonstrate that they are to be paid at least the prevailing wage for the position.
  • H2-B visa: An H2B visa is a temporary work visa for foreign workers with a job offer for seasonal, non-agricultural work in the US. The H2B visa program is open to nationals of countries designated by the United States Secretary of Homeland Security.
